Terms of Use

These Terms of Use ("Terms") are an agreement between you and MiPose ("we", "us" or "our") and govern your use of the MiPose app for iPhone and this website (together, the "Service"). By downloading, accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

If you downloaded MiPose from the App Store, Apple's Licensed Application End User License Agreement also applies. If anything in these Terms conflicts with it, these Terms apply to the extent the law allows. How we handle your data is explained in our Privacy Policy.

Your Account

You need an account to use MiPose, created by signing in with Apple or Google. You are responsible for keeping access to that sign-in secure and for activity on your account. You must be at least 13 years old to use the Service. You can delete your account at any time in the app, under Profile → Delete account.

MiPose Premium Subscriptions

Access to MiPose's pose library and camera features requires a MiPose Premium subscription, offered as a monthly or annual plan. The price and length of each plan are shown in the app before you buy.

• Payment is charged to your Apple ID when you confirm your purchase.
• Your subscription renews automatically at the same price and length unless you cancel it at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the current period ends.
• You can manage or cancel your subscription at any time in Settings → your name → Subscriptions on your iPhone. After cancelling, you keep Premium until the end of the period you have paid for.
• If a free trial is offered, you are charged when it ends unless you cancel at least 24 hours before. Any unused part of a free trial ends when you buy a subscription.
• Deleting your account or the app does not cancel your subscription.
• Purchases are processed by Apple, and refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.

If we change subscription prices, Apple will tell you in advance and, where required, ask for your consent before your next renewal.

Poses and Content

The poses, pose images and outlines, guidance, text and design in MiPose belong to us or our licensors. While you follow these Terms, we give you a personal, non-transferable licence to use them in the app to take your own photos. You may not copy, download in bulk, resell, redistribute or publish the pose library, images or outlines, or use them to build a competing product.

Your Photos

The photos you take with MiPose are yours. They are saved to your own Photos library and are not uploaded to us, and the pose outline is never part of your photo. You are responsible for the photos you take and share, including having the consent of anyone you photograph.

Pose Safely

Pose suggestions are for inspiration only. Only try poses you are comfortable with and physically able to do, and always pay attention to your surroundings: don't pose anywhere unsafe, such as near edges, traffic or water. You are responsible for your own safety and for respecting the places and people around you.

Acceptable Use

You agree not to:

• use the Service for anything unlawful or harmful;
• try to copy, reverse engineer, scrape or interfere with the Service or its servers;
• get around subscription checks or share access to Premium;
• use the Service in a way that infringes other people's rights.

Changes to the Service

We are always improving MiPose, so we may add, change or remove poses and features. We will not remove core features you have paid for during a subscription period without good reason.

Termination

We may suspend or end your access if you seriously or repeatedly break these Terms. You can stop using the Service and delete your account at any time.

Limitation of Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law, and nothing affects your statutory rights as a consumer.

Subject to that, we are not liable for losses that were not reasonably foreseeable, for indirect or consequential loss, or for loss of data or profits. Our total liability to you in connection with the Service is limited to the amount you paid for MiPose Premium in the 12 months before the claim.

The Service "As Is"

We work hard to keep MiPose running smoothly, but we provide the Service "as is" and "as available". To the extent the law allows, we do not promise that it will always be available, uninterrupted or error-free, or that it will meet every need you have.

Governing Law and Disputes

These Terms are governed by the laws of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you live in the European Union, you also benefit from any mandatory protections of the law of the country you live in. If you have a concern, please contact us first so we can try to resolve it informally.

United States Legal Compliance

You confirm that you are not located in a country subject to a United States government embargo, or designated by the United States government as a "terrorist supporting" country, and that you are not listed on any United States government list of prohibited or restricted parties.

General

If any part of these Terms is found to be unenforceable, the rest remains in effect. If we don't enforce a right straight away, we can still enforce it later. These Terms are written in English, and the English version applies if there is ever a difference with a translation.

Changes to These Terms

We may update these Terms from time to time. The new version will be posted on this page with a new "Last updated" date. If a change is significant, we will give you reasonable notice, normally at least 30 days, before it takes effect. If you keep using the Service after that, you accept the updated Terms.
